Our Services available from the Mediation Board

Attempts to resolve disputes through negotiations referring to the Mediation Board as follows:

  • Conflicts referred privately by a disputant. 
  • Conflicts referred to the courts.
  • Conflicts referred by the police.

 

Following Conflicts are discussed before a panel of three mediators appointed at the parties and,

  • A settlement report / certificate in case of settlement by mutual consent and,
  • If a settlement is not reached, a non-settlement report / certificate will be issued.
  • Copies will be forwarded to the court / police as applicable.

You can personally refer a conflict to the Mediation Board with the following informative letter or form

  • Name, address and telephone number of the complainant
  • Names and addresses of other parties
  • A brief description of the conflict

Should have a valid Rs. 5 / - stamped and signed on the end of the letter or on the relevant form.

This can be mailed to the Chairman of the Mediation Board or taken to the Mediation Board Meeting and handed over.

The following Conflicts cannot be filed in court without a certificate of non-settlement issued by the Mediation Board.

  • Conflicts related to movable / immovable property loans and damages not exceeding Rs. 500,000
  • Errors in the Second Schedule of the Mediation Boards Act.
  • Theft less than Rs. 5000 / - by a minor (excluding cattle theft)
  • Conflicts relating to any case not mentioned in the Third Schedule of the Mediation Boards Act.

Disputes and wrongdoings which must be referred to the Mediation Board as mentioned above shall be referred to the Mediation Board by the Courts and the Police and may also be referred by a party.

  • Conflicts in which one party is the "government"
  • When a Conflicts is a dispute over the recovery of money, property, or other liabilities, one of the parties is a "public servant who acts like a public servant."
  • Conflicts filed by the judge
  • Conflicts not mentioned in the Second Schedule of the Mediation Boards Act
  • Conflicts related to a case under the Third Schedule of the Mediation Boards Act

Recruitment of Mediators for the Mediation Board

Recruitment of Mediators for the Mediation Board

  • A Mediation Board has been established in each Divisional Secretariat.
  • Mediators are selected from among those who live or work in the division, who do not engage in divisive politics, and who live with good social standing.
  • Nominations are called by gazette notification every 3 years for the recruitment of mediators and no one can apply on their own.
  • Instead, the nomination should be made by a person who has the power to send nominations as mentioned in the gazette notification.
  • The nominees will be selected through an interview and given training on mediation skills and tactics and the most talented trainees will be appointed as mediators.

 

Serve as mediators

  • The term of office of a mediator is 3 years
  • The mediator is considered a public servant according to the Penal Code during his tenure in a mediation board.
  • All Mediation Boards are subject to the supervision, control and disciplinary control of the Mediation Boards Commission and are chaired by a Chairperson.
  • Mediation Board meetings are often held on weekends.
  • A travel allowance of Rs. 1000/- is paid to a mediator for one day attendance at Mediation Board meetings.

 

Submission of nominations

 There are 3 forms for this.

  • Form "අ" refers to the head of a religious place, the head of a regional department, a principal, the head of a retired department, or a retired principal.View"අ" Form
  • Form "ආ" to the secretary of a non-political voluntary organization, board or institution.View"ආ" Form
  • Form “ඇ” to the Divisional Secretary of the relevant Division or the Government Agent of the relevant District.Nominations can be submitted.View“ඇ” Form
